Marzouq sent me a link to this today and I can’t believe its true. It seems some places like Kempinski Hotel in the Mall of Emirates are asking people to sign waivers which say that if you get food poisoned they are not responsible. Freaky. [Link]

This is BS and is not enforceable in courts. You cannot waive your right to damages in case of personal prejudice. by personal prejudices I mean any prejudice affecting one’s health, the integrity of one’s body or one’s security. If the courts in Dubai enforce such waiver that would be a heresy to the General Principles of Law and to common sense.
The owners of such restaurants are intimidating their customers giving them illusions in case they think to lodge a complaint.
Rubbish. Been eating out all week here in Dubai and have not encountered any such thing.
As to the “no Control” excuse given by the restaurant, it is the court which decides on whether the restaurant has or had not control over the consumed product. The court’s decision is based on factual investigations with the victims and the witnesses. The court will not hold the restaurant liable in case of any doubt in establishing the facts.
The “Hotel” is distancing itself from the “Restaurants”.
This is simple, the hotel is saying they are not responsible for the outlets in it as they don’t control the food quality as they are independent companies.
Ex: if you get food poisoning in “Le Notre” you are not going to sue “Marina Mall”.

As to the Hotel, they may sign an indemnification agreement with the restaurant located in their outlet in case of any claim againt the hotel for food poisoning at the restaurant. Thi is how they protect themselves. The lawyer should have advised them so.

Simple… If they’re afraid of u being poisoned by thier own food and make u sign papers before eating, then there must be cause for alarm, so walk out of restaurant. If they say anything, just explain why you feel alarmed, when all you did was to come and have lunch.

This could be true…the incident about the 5-year-old boy and his 7-year-old sister getting food poisoned is true…it was all over the uae news about 3 months back…even got some emails abt it bak then…
yeah so does crowne plaza on s zayed road. but they only make me sign a paper, when i ask for a take away, or to pack the food in a doggy bag…
That basically means that the restaurant is sayin, “hey, every once in a while we may not serve you the cleanest food so please give us a break when that happens”.

Never heard or seen such an act before. Unless (if I am not mistaken) in other parts of the world I think you would have to sign a piece of paper for eating a special food delicacy that only a top chef would serve. For example a Japanese puffer fish.
Funny that this should come up and I am not totally suprised. The Pizza Hut out let in the City Center Mall Salmiya had a problem with giving us a doggy bag for the extra salad we ordered. Apperently there were under notice by the Health Dept coz a customer had food poisoning after eating a take away salad. Turns out that the idiot who took it left the salad in the car in the heat for a couple of hours, refridgearated it when he got home and then had it for dinner later that night. Any guesses as to what happened to the potato salad while it was stewing in the heat ??? No wonder the dum ass got sick.
Anyways the manager a really decent lebanese bloke actually took the time to explain to us why he coudnt do it, but once we told him we werent like the idiot he gave as a take away box and reminded us … dont leave it in the heat and eat it later and dont blame Pizza Hut if you do ;-o)
As for holding a hotel responsible for the food served in its restaurants .. I totaly agree.. No such thing as a hotel distancing it self….. after all its their reputation on the line.. who else would you blame for bad sushi and u get sick say for example from the Sakura Rest if not the Crowne Plaza management. After all the F&B department is responsible for all the food & drink it serves to their guests living in or other wise. As for a waiver I think its over kill if you go to a reputed hotel you expect good food and service not food poisoning. One time is enough.. once word gets out that some one got food poisoning from a paticular restaurant and it is proven; then the rep of the hotel and the restaurant is tarnished. No one will want to come again.

A restaurant in a hotel and a restaurant in a mall are 02 different subjects. Any eatery in mall is responsible 100% for the food it serves and the mall management is not responsible. The mall management is only responsible to make sure they follow all governing rules and conditions which concern collection of rent which the eatery owes at the end of the month, fire codes, cleaniness, space mangement etc. What happens in the kitchen of that paticular restaurant is the responsibility of that paticular restaurant management and owner.
In case of a hotel however its different; the hotel is liable for any food and beverage its restaurants or cafes offer its guests under their roof.

This is true – I was at Dubai Creek Golf Club with some friends in Dubai 2 weeks ago who ordered their burgers done “medium”, at which point the waitress said that it was a requirement of the Dubai Municipality that the diners sign a waiver before they would be served. Alternatively, they could order “medium – well done” and they wouldn’t need to sign anything.
The letter they signed actually referred to the instruction from the Municpality that a waiver is required before underdone foof can be served.
As someone else pointed out, it is also enforced on anyone taking away food from a restaurant and it can all be traced back to a few cases of food poisoning some time earlier this year.
As far as the “Hotel” distancing itself from the “Restaurants” is concerned, the hotels should sign these agreements directly with the restaurants so that no liability is passed on to the hotel itself. It’s crazy that they should ask the customers to sign. They can just have a disclosure in the menu. In the US restaurants in most states are required to have a disclosure in their menus that eating raw or undercooked animal foods may cause illness; to protect their business against consumer lawsuits. I’ve pasted some information below.
Disclosure: Identification of the animal foods served undercooked. The disclosure must:
– be written
– be on the menu (or otherwise presented to customers in writing at the time they place their order).
– identify the food items that are served raw or undercooked
Reminder: Statement of the health risk of consuming these foods. The reminder must:
– be written
– be printed on the menu where customers can easily find it (preferably on the page where the first undercooked item appears) or otherwise presented to customers
for one thing most places should take pride in the fact that they don’t ’cause food poisoning not make people sign a waiver so that their chef can add cat piss to our food ……
There’s a huge risk if people continue to eat leftover food that hasn’t been refrigerated within an hour and even a bigger risk if it’s chinese or japanese food!
This is total bullshit. You get food poisening after 12 hours from eating at a restaurant.. definitely the restaurant!
