Kuwait Law: How can I get a release from my company?

My problem with my company is the time they take for cancellation of residence after my 3 months notice period.

After completion of 3 months notice period my company needs 2 weeks to settle my dues and only after that will they apply for cancellation of residence which according to them will take another 1 week or more.

Which means I will be in Kuwait for another month paying my rent without a job.

Do companies need such leisurely time in out expense even for cancellation ?

They supposed to start the residency cancelation process 2 or 3 weeks prior to the end of the notice period, cause you might have another commitment with another organization

My sister’s husband is having trouble regarding his visa not being transferred ahead to his new Company. His new company took 3 months to process such VISA until his old Company sued him of not fulfilling the said requirements. Any lawful advise please. Thank you.

i am in Kuwait now. It’s been 3 months since I came. According to the agreement my duty is 8 hours. 180 Kd. But here i have to work 10 hours per day and there is no provision for overtime for working more. How i can complain without knowing the company.

a) Can the company cancel your residence during the 3 Month Notice period ? Is there a waiting period ?

b) Is it mandatory for the new company to stamp residence within the probation period ?

c) If an employee is let go during the probation period, then what is owed to him ? Let’s say he is let go during the first month, does he have to be paid the salary for the probation period entirely i.e 100 Days ?

Not a lawyer, but if you are let go during probation nothing is owed to you. The entire point is you weren’t good enough to hire so no there’s no reason they would pay you the rest of the 100 days. It goes both ways, if you’re on probation you can just call them and say “I’m not coming in anymore bye” and there’s nothing they can do.

Many of our Contractors complain that their passports are held by their company for ‘safekeeping’. I believe Kharafi National, Kuwait’s largest Contractor (I think so?) does that to its more than 20,000 employees. What’s your take on that.

The company where I worked before used to issue visit visas in the name of employees that said they were leaving kuwait – just in case they want to come back and join another company, then the new company could not issue a visa for the employee.

The law is too protective for the employers as it stands right now.

My friend i was searching for you. My company does the same thing for us too, my friends are stuck in India as the company for which i am working issued a visit visa on them. Eventhough they got a nice job with good pay, they cannot return back to kuwait. Pls find a solution to this issue. Many employees are facing much problems because of this company.

In my company they have made contract saying that u can’t go to work in same business company for three years or u have to pay 1000 kd if they come to no and if u get a better offer from same business company the owner don’t want to sign the release paper and they will not give the last month salary also.

They do this in Dubai too, from what I heard they actually enforce it there but I’ve never heard of it being enforced in Kuwait

What if you worked the time that is being written in your contract (1 year), but the company wants you to work 2 years more and doesn’t want to give the release?!

Also, over-time is never paid; it’s allowed only to take the extra worked hours as free time.

What if you just pack everything and leave Kuwait? What will be the consequences?!

P.S.: Before coming to Kuwait, I have been promised another things. And here I was given to sign a contract exclusively in Arabic (and I can’t read it)?!

A friend of mine who’d work for this *company for almost 12 years, and now the company is in deep trouble. The questions are;
1. If she will resign before the company declared bankruptcy, can she get her indemnity?
2. If she had to wait until the company will close, does the said company have the obligation to pay her compensation?

Some general guidelines to make sure we aren’t taken for a ride in the contracts. For example: I read in a few articles in Arabian Business that the landlord is not allowed to raise the rent for the first 5 years.

As many know, rents are going up and apartments are getting smaller. So moving to a better place is becoming a bit of a challenge and if there is a steady hike in rent year on year as is happening at my present location, pretty soon I will be spending large parts of my earnings on accommodation alone. I have just finished with my current company in Kuwait (it was not a specified contract and I have worked my full 3 months notice) and I am transferring to another company in Kuwait. Other than the fact that everything is very drawn out process with my ex company, they are telling me they will not release my final salary until they have a copy of my new residency, new permit to work and new civil ID. I want to join another company and i tried resigning from my current company, my manager does not want to accept my resignation paper, she is saying that accepting that paper means she accepted my resignation already, which is absurd(i know!) … She told me that “according to labor law: both parties has to agree for termination of contract, and i have to do the 3 months notice period”. I actually read the labor law article 44 states that both parties shall have the right to terminate the contract but you have to give 3 months notice, in the event that the employee does not want to finish the notice period employee has to pay the equivalent amout of notice period…. What my manager is saying that both parties has to agree, labor law doesnt state any of that.

Good day to all. Just like to ask some advise regarding my situation.

I am a degree holder, with attested certifications. I came here to Kuwait last March 2013 with article 14 visa and then lately transfer to article 18. I am an engineer with electrical background. From the start of my work, my company was able to give the job that is in line with the experience – which is electrical. However, after my first project last January 2014, my company put me in works far from my experience and qualifications – now I am working in civil project. They promise me that this will be temporary but until now, I am still working in civil project. There is an offer I received from other company for jobs that is in line with my experience and with greater compensation. But when I ask my sponsor for transfer, he said that he will not allow my released and I should got back to my country.

I am not fully aware what the law states. Can my sponsor do that?

It is very very common for employers to hold passports, hold their employees as if they were slaves. Very very common to be verbally, mentally abused. Made to work on public holidays, weekends.

I think it is the mistake of the expatriate who choose to work in a culture that allows all this abuse. I wouldn’t work in that country even if I was paid a million bucks ! Money is not everything.. You earn to live and not live to earn ! Get out and find a better country to work, where your rights and dignity is respected !

Kadim → Kadim(Company A) → Shoun (Compamy A) Now my confusion is 1. After how many years i am eligible for release i have attested degree? 2. To be honest brother its only 3 years you can have release. But because we are expat here. Even if you file release labor will make sure that you will have to wait for 1yr to 2yrs before having you right. Even if you have lawyer, they cant expedite your case to finish early. Keep in mind this is not our country. They always favor the Employer while claiming your rights too.

I am in my current contract here in Kuwait, I want to leave this place and found a job somewhere in UAE, I cant give a resignation letter because i will be paying penalty of KD5000 as per my contract .Is there any case that can be filed on me if I just leave on time of my vacation and go straight to UAE? Here’s my situation:

– I used to have visa 20 and lucky enough, I was hired by one company even if i don’t have visa 18 yet. What they did they transferred my visa 20 (which is just 5 months) to visa 20 under our Managing Director’s name because they said its not possible to transfer 20 to 18 if you have different sponsor (which i also knew anyway so i’m all good with that).

When my visa 20 is already under my Managing Director’s sponsorship, they told me that as soon as the transfer for 20 to 18 will be open, they will immediately transfer it. So when transfer from 20 to 18 is all good and open, they transferred it yes, however they told me that it should be under one of my Managing Director’s owned business and not under the company where I’m currently working because our company is under a Big Group of Companies. Everything was fine with me because they told me that as soon as I’m holding 18 visa under my Managing Director’s company, they can transfer it to our company’s name anytime.

Now, our mandoop told me that its not possible since I need to wait another 1 year before my visa will be transferable (but before they told me it can be transfer)..

My salary is just 200kd (I’m Computer Engineer and that’s the same as what’s indicated on my visa now) so I’m actually looking for another job where i will be compensated more. But I’m afraid they will not allow me to transfer the Visa that I currently have..

As of the moment its my 12th month working in this company but my visa 18 is still not under their name and its only 2 months till this date. Is there a way for me to move from this company to another because technically my visa is under different company’s name?

you dont have the right to complain if ur emloyer doesnt want u to give a release, because he hired you from philippines and he have the right to send u back from your country after ur 2 years contact.

It seems when the mandoob of the new company went for work permit for the new company, I am joining into, they said, it has been blocked, because i have not completed one year with my present employer. My present employer has given me release and all documents signed for transfer.

Hi please help me with this matter. My father passed his resination letter to his employer in kuwait last Jan 2015 . He said he did not want to signed aand extent anymore his contract. His contract and visa validity is only up until this June 28, 2015. His employer doesnt want to accept his resignation letter and he was forcing my father to extend another years of contract. Hello Sir I have been working in Kuwait more than ten years & I make the my one year visa from 28th September 2014 to 29th September 2015 { & he ask me to go & work outside any company with his visa } with one Kuwaiti Gentlemen visa article no 18 , & I pay him for this visa 450KD to get this visa so it’s OK And I asked him to write my salary 300KD In the work permit & he done it and he asked me give 300KD to keep with him & Opened one Bank Account he deposit that 300KD & removing it as he keeping The ATM CARD that’s OK, But now I have worked with one company about 6 month & that company ready to transfer my visa to other company. Then I call this My Kuwaiti Gentleman & I told him about this & he told me after the EID FASTIVWEL he can give me release. five days before I got the visa transfer paper done by my New company & they give me that paper & asked me to go & bring the Release from my present Kuwaiti Gentlemen. Then I call him but now his Mobil is close & I don’t have his any other mobile contact details & I don’t know his office & where he living as one of my friend introduce him to me. So how can I contact him to get the Release but He has given me the copy of ESNAMTH THOKIYA I have PLASE SIR CAN YOU GIVE ME SOME IDEYAR WHAT TODO? AS I DONT HAVE ANY BODAY TO HEALP ME.

Is there anyone here can help me on hows the procedure to cancel my residency (Visa 18)? I didn’t signed any contract with the company (I don’t know if it was the arabic paper that i signed last time when they tried to apply for the work permit, lol :D) I worked for about 1.5 years, yes just renewed my visa 5 months ago… I pass my resignation letter 2 months ago, my boss said okay, but until now we haven’t process any cancellation for my residency and yes I bought airtix go home next week 26 August. My boss said he will cancel my visa the day before I left Kuwait, Is it true? How long does it takes to cancel your residency? Or should I just go (My passport with me tho).

Hi I just want to ask this question my old employer they don’t want to give a release but I’m working w/them for 3years now I’ll already give my resignation later and they give a 3months probation w/ 2months extension , now that I find a new job and I’ll send a job acceptance to them now they said they can’t give me a release . His reason is when I start working w/them my visa is 20 then they transfer my visa to 18 , but when they transfer my visa to them They let me pay every year when my visa is finish they reniew and I pay again and again for my visa ,and now they said they will agree to transfer me to another company but they what to change my visa 18 to 20 again (my question is? ) it possible my visa 18 transfer again to visa 20 even f I’m the one Who pay for my visa to transfer w thier names ? Dear sir/mam I have a big problem for my work now, what shall I do so that they release me in our company? I’ve been assaulted yesterday by choking my neck without valid reason, and also I worked more than 8hours in our company and they didn’t pay for overtime. They don’t give our salary in exact date and it’s always late for 10 or 12 days, if we are not feeling well and we need to absent for sick leave they only give us just half day off, and if more than they deduct our salary of 10kd everytime we absent sir mam,. my problem of my present company is that they still didnt give the incentives we have for more than 1 year and everytime we are asking for that incentives they’re answered was the company doesnt have money yet.. is that right answer?

one more thing is that they’re not giving the holiday off on all staff they will just say we can take off set later but if we want to take it its hard for them to give the holiday that is for staff they will answered we cannot take because we dont have sale…thats why all staff are having 100 plus some are 200 plus extra hours..me i have 160 extra hours.. so what i am going to do?

I just want to consult my case about my visa transfer. .I work before in 1company for more than 3years and take a release from that company, now I work with the new company and they transferred already my visa to them..now I dont feel to work with them anymore because I did not feel happy to work with them. I tell to my restaurant manager that I will not to work anymore as part of my probationary period of 100days is still not done.and the day after I go to our company and tell that I will not continue my work and im allowed to not proceed my work to them,and my company not allowing me to release from them. The H.R told me that im blocked in shoun and cannot find another job because they will not release me..they give me an option to finish first 2years of work to them or go back to my country of origin.I didn’t sign any contract to them that I need to finish 2years before I can go from them, I just sign only my job offer that they given to me.

I just want to ask. My sister is having a trouble getting a new visa from a new employer (private sector) in Kuwait. Because the agency in the Philippines told her that her visa from her previous employer which was Ahmadi Hospital under GTC has not cancelled her visa yet.
She left her job in due to personal circumstance last June 2014 and her civil ID was already expired since January 2015. My sister heard that you have to pay first before they can issue your papers an cancelled the visa.

Is this right?
What can we do with this problem?
Who should I ask for help with this?

i am in my current contract here in Kuwait, I want to leave this place and I want go back to my country , I cant give a resignation letter because i will be paying penalty of KD5000 as per my contract .Is there any case that can be filed on me if I just leave on time of my vacation and go straight to UAE? Some says I might be blacklisted in the entire GCC if my current employer will file a case. Is this true? please I need legal infos.

I gave my resignation on 25th May 2015 to my employer by hand & through official e-mail. he didn’t accpect my resignation and told you willnot get release now.Again I gave my resignation on 30th September 2015. The employer accecpt my resignation verbally but he didn’t sign on my resignation.I request him to sign & give me copy of resignation he didn’t do, I cannot force him also to sign.But sent the resignation letter as an attachment through e-mail on 14/10/2015.He told they will appoint a replacement for me from November onwards so that I can hand over my duties & reponsibilities.But the employer from October 7th is not comming to office.I am sending e-mails regarding the updates of my replacement no response from his side.Then October 2rnd week I conducted interviews I selected 10 candidates ,out of that 3 I selected. I gave three CV to Mandoop to give to my employer so that they can finalize with one.Employer told mandoop replacement of my place will be done in 1st December 2015.Now the employer is telling he will not give release since he has not signed my resigm=nation.

I got another better opportunity & I want to Join there on 3rd of January 2016.
I want to know how I can get rid off from this situation & if the employer is not signs my resignation what is the solution?

Hi I am working in maintenance in a private school in kuwait.The school is violating labour law in various aspects like letting its staff pay yearly insurance fee and visa renewal fees which comes around 76kd every year. It gives its staff just 30 days maternity leave. It keeps passport of its employees without giving any written statement. It increased salary for all its staff except for me though not mentioned in the contract. Now gave my resignation and by the end of January I complete the notice period. My residency get expired by April 25. They want me to pay 2 months salary to the company (February and March salary). If I am not an academic staff, why do I have to complete more than the notice period?

I would like to know, I join to one of the restaurant which has no rules and policies to follow,my employer is a government server.he do not follow the labour law of Kuwait ,working hours is 10 with no meals.i did not sign any contract but my residence is under his name .as I worked with for three month and I planned to stop working , after I inform him that I need to have release but instead of giving me an release he asked me to pay him money which is not right . My story goes like this:
Was born and raised in Kuwait, went to India for my bachelor’s degree in engineering WHILE MAINTAINING my residence here in Kuwait. Jump 4 years forward, and today I’m back to Kuwait, and working in a company.
Problem is, the company I joined didn’t have any vacancy of an engineer in the “file”, and so, my residence is that of a technician. I’ve been working here for about a year, and would want to change companies now.
Will it be a problem for me while changing jobs? From a technican’s post to that of an engineer’s? I also happen to work in a production company, and someone told me that if I have to change my job now, I must get into a similar industry (production).
Could anyone be kind enough to help me out? Any sort of relevant feedback would be appreciated!

Salam. I just want legal advise or anything that could possibly help me with the problem i am facing right now. I was hired locally by this company last 2011. At that time, they were not able to transfer my papers to their company for some reasons. They told me to go back in Philippines. I went home and they sent me visa. Just visa. I shouldered every expenses for the processing such as medical and tickets for coming here. Then, i started working in their company under their license and name last dec 2011. Good day to you i just want to ask and clarify some thing as a domestic worker here for 8years i decided to ask release for my employer if she can give me release to find & work another job, but she tell me sorry for now coz there is a new policies in kuwait that (she) my employer are not allowed to give release for a 20 visa like me. She said if you want to work outside you go back in your country and apply another work to get back here..😢😢😢
My question Sir is it true that my employer are not allowed ti give release to me or she’s just making her own rules. Thanks & God Bless..

Hi, I am working for an restaurant which is family business I submit my resignation due to they request me to transfer my accommodation or they will stop my transport.. when I talk to them to give me only transport for 3 month after my resignation which I don’t want to stop working . Then after discussion they ask me to submit my resignation and said they will let me know . As my days started they said they cannot give me transport which I have to arrange on my own . Which I cannot provide due to its late hours in the night . So I stop working as the HR knows bout the situation. After a week they send me an email mentioning that as per the kuwait labor law the will file case against me . Btw the my employer did not follow any muwa labor ( they let us pay for visa , health card , not paying public holiday, deductions salary without the knowledge of employees ) what is the right way to solve this issue .

I m a nurse project visa (5 yrs) signed duly and problems are delayed salary (2 months) , holding passports and cwrtficates, compulsory overtime, compulsory signing on cheque (3000 kd),etc… 1)will I get release from my company ? How to obtain passport and certificates? If I go Shoon will I face any problems??

Sir, I have 18 no. company visa. When i told in my company for give some emergency Leave But company not agree with any certain days of leave. My First day Kuwait was 19- Oct.-2016. already completed my 9 months as from Oct. Month. So, I put a resign and already give 2 months notice period. My Civil ID expired in November End. so, m i eligible now for company Leave ? as per law. and my contract mansion like (This contract is applicable for period from on arrival to ONE YEAR). My Contract is Only For one year. So, Please Guide Me when i can go ?

I am in Visa 18 as an Engineer. I am resigning from a company .Current company as asking me to transfer Iqama to new company immediately after last working day. But new company has clearly mentioned that they will transfer iqama after probation period of 100 days only.

In this case , please suggest whether I can proceed working with current company iqama till that 100 days. And is it legal ? as the current company asking to transfer immediately after last working day.

IM almost 4mons here in kuwait but my employer hasnt give the civil id. Or baladia id. Im 18visa. They didnt paid us for legal holidays because my manager said we are a ”private company” is this legal? Based on my contract holidays should be paid double f working. The addrezs written in the contract is not the same address i am residing now.

Unfortunately before start to restaurant it’s close because of corona came
Then they pay 40% of salary until this july not a exactly date but they pay. Residency transfer just only August 26 2020 still they not open Resturent
Then I have new company offer to join with them
My question is I can move to new company passed by my resignation to my present company or is there any low I can’t do that

I found a new job at school, I was already resign since march 31 2020.
And because of covid I couldnt join on my new company immediately.
I started to my new company last May 3, 2020 and work for 1 week.
My probition period was interrupted because of total lock down.
And I resume to work last july 19, 2020 now I’am working for almost 2months.
My probitionary period will end on november 19, 2020
Suddenly my previous company are calling my attention.
They are telling me that my visa should be transfered this end of month september.
Otherwise they will CANCEL my visa.
My civil ID will expire on December 2020.
My question is that possible that they can cancel my visa?
If possible what are going to happen to me?
With this issue, what should I do?

I am working with one of University here in kuwait, they sponsored me visa and i joined on Sept 2018. so its been 2 years and 7 months. i got another good job so i resigned now, at the joining time recruiter told me that you can move out after successfully completing 11 months but now they are asking to complete 3 years else instead of giving transfer they threatening me to sent back to home country. as of now i am serving notice period and at the end of notice it will be 2 years and 10 months.

Hi ! I am a sales lady here in kuwait i was sponsored by my mother and boss to get me from philippines my question is can i get release from my boss even if i am 18visa but small project visa? Im almost 2 years working to him now and i really want to leave him because he break the contract that i signed in my agency in philippines even the salary that mention to my contact was not the same to what i recieve everymonth and the day off should be once a week but my boss only allow me to have once a month day off. my salary should be 250kd because that what i sign but i only recieve 195kd and to my contract mention that im free accomodation free transport and free food. But all of it never happen and now im almost 2 years and my contract to him will be finish after 2 months from now.
I rent a partition here in kuwait city where some 20 visa also living here and the partion im rent is 110kd and its only half room that i rented but very expensive.
