Al-Qabas steals pictures from Bahraini blogger

A Bahraini blogger called Aysha was surprised to find out that not only did Al-Qabas newspaper steal one of her pictures and publish it in the newspaper but that the picture they stole was a picture of herself. She was completely shocked and surprised to find her picture plastered in Al-Qabas and now wonders if there is anything she can do. Sadly I doubt there is anything she can do about this and we all know this isn’t the first time that Al-Qabas uses pictures without permission.

yeah but i can’t imagine that been a simple, cheap and short process. I doubt it’s very practical to sue a newspaper in Kuwait while living in Bahrain.

Mark its not costly at all by the way..im speaking from experience…all she has to do is appoint an attorney here in kuwait and he/she will follow the case..she doesnt have to keep coming back herself

they stole from me before, but i ignored them. Can’t do anything about it. They roam over flickr and other websites and collect all they need from there.

This is why i NEVER posted my pic ANYWHERE ! no blogs no facebook no twitter not anything !

Heyyy everyone! And thanks Mark for posting this up…
I just feel slightly violated that a newspaper would let one of their own journalists browse through the net, and just post up a random image without double checking the source of the image. It’s my personal blog, and I should be able to post whatever I’d like up without finding a facebook post from a friend of mine on my page about it. If he hadn’t told me about it I would have never known.
Is journalism in the Gulf that messed up? I plan on sending in a formal complaint to the editor of the newspaper & we’ll take it from there. A law suit is something I’m going to have to discuss with my family. Maybe too many people have stayed quiet in the past & a change might be needed.

Going to court won’t be easy I think, they’ll just drag it and drag it – argue, counter argue, counter argue point 1, argue counter point, counter point 2 etc. etc. Time consuming and will take a mental and physical toll on Aysha I think.

Its a disgrace and disrespectful that they would do this to her.

I think the best thing to do is expose them for their unproffesionalism they have, they might have the money to buy alot of things but respect it ain’t. Cowards!

She’s a middle eastern girl she should know that copyright laws are not very stringent. Nevertheless she should complain.

This isn’t America where you can challenge people in court, unless you’re a Kuwaiti who can afford a lawyer (or anyone who is patient with the system).

Yes mark, she can sue them, she realllllly should! and no it doesnt HAVE to be expensive. most settle outside of court. not everything must be difficult, dont make it out to be as such.

I’m saying that the Dior dry cleaning logo is the exact same as the Dior clothing logo.

I am assuming though that they do not have permission to use this logo…maybe they do?? ๐Ÿ™‚

Sorry to hear about your article in the arab times. That’s just crazy. It would at least be nice if they credited the writers.

Journalism in the Arab world does not have boundries…except for the defamation of of Islam, God and his prophets. Other than that they lack in straucture, ethics and originality.
Journalism in the Arab world is a flat-out joke.

We all acknowledge that publishing pictures without permission is absolutely wrong along with countless illegal things done across Kuwait from stealing logos, pirated movies, downloading songs, etc. It is morally and ethically not okay to do so as long as the content has copy rights. It is even worse to be passive about. If there is no law enforcement, ethics should stand still. Mark, Aysha and everyone else who’s rights were violated shouldn’t keep silent. Make a big deal out of it so that change can be done. If the change is not wanted, this implies that you are committing these crimes yourself.

By the way, you don’t have to be physically here to fight the lawsuit. Just appoint a lawyer, that’s it.

The ‘argument/counter-argument’ is the job of the lawyer, not the client.

The newspaper will probably argue the following:

1. The photo was posted on the Internet, so its in public domain, so we can use it freely. This is wrong. Public domain works are strictly defined.

2. There was no copyright or clearance information given. Copyright is active by default, even if you don’t specifically state it.

3. “Oops”.

4. Settle out of court. I highly doubt this, unless the girl hires a crack lawyer who is up to speed on IP laws.

This for the photos – as for copying straight articles and posting them … depending on where it was posted, it may be not be illegal (note, illegal and “not right” are two very different concepts). So if they have a section called “Kuwait on the Net” or similar and they post things with a link, this is completely legal.

If they just took the post and wrote it up as an individual news entry, then that is plagiarism.
