How to report your Employer for not Paying Salaries

There is an interesting conversation currently on Reddit regarding companies who either reduced salaries because of the pandemic, or who missed or aren’t paying the salaries. Not sure how many of my readers are going through this issue but if you are and want to file a complaint you can do so by contacting the Public Authority of Manpower:

For the information of other readers… If you have a clean chit in your history of employment with your employer, the Kuwait court of law always stands by the employees claim. Most expats are concerned about not getting justice because they are an expat – And that is not true. Also, to reiterate what has already been mentioned in the Reddit thread… You can report without your employer knowing (they needn’t know). But once reported, the claim won’t be anonymous anymore. Trust me… it is a smooth process but at least upto 2 years of waiting to receive your benefits. #beentheredonethat

Apparently, there happens to be a new rule that passed during the pandemic where the employer needn’t pay the whole salary or part of it. I’m not really sure. Been sailing smooth since the pandemic #ThankGod. But this “new rule” is something you need to check before making the claim.

Everyone reads the same words but takes away a different message. If you have understood what you could understand from the above comment, that’s good enough. Good day!

it means you can report your employer without informing your employer. in other words, you don’t need to have informed your employer before submitting the complaint, but after submitting it, your employer will know exactly which employee has submitted the complaint.

the wording may not easy to understand, but it is grammatically and logically correct.

I think the statement is very clear.

You can submit a complaint *anonymously* but once its out there, its obvious your employer will know based on the case facts stated by you. So even though the authorities wont reveal your name (in case you have stated), your company will be able to figure out who it was.

This is of course based on the assumption that your case facts are unique and you are the only one submitting a complaint. Even if the system did operate like a class action lawsuit, it will be relatively easy for your employer to figure out who all were involved.

I wonder if a similar reporting can be made if the final settlement is not being paid by the previous employer.

If not, can someone please guide me? I had my visa transferred at the end of August. Sent across my transfer papers to the previous employer by email … Sponsor, CEO and the accountant were copied in. Two weeks later, my colleague who was also terminated with me got a call from the sponsor saying that they will pay the two of us as soon as he has money. Close to two months now and the same colleague spoke to the CEO and was told that it is unlikely that we get paid as there has been an indefinite delay in receiving some funds they were expecting. In the meanwhile, the sponsor has gone ahead and started a new business and is splurging money on his needs.

BTW. Is there some time limit by which a claim has to be made? Is it possible that the sponsor is using delay tactics by calling my colleague and telling him that we will be paid soon?

Someone else can direct you to a more legal and precise solution regarding the time window, etc.. But as a layman, I would say… register a complaint on the issue of your final settlement. You may convey to your sponsor that you are doing this only to protect your interest. At any time when your sponsor pays you, you may cancel the complaint with the shu2oon. You aren’t doing this out of spite; so I hope your previous sponsor understands.

You have 1 year from your termination date to file a claim. If you need some advice, my lawyer is great and will give you free consultation. I was terminated during lockdown in March and he made me wait until September to give me only half of my settlement..took 2019 leave carry over to pay 2 months of my salary during my termination period .. His words were take or leave it πŸ™ˆ discusting way to teat people. If you want the lawyer number let me know πŸ™

As Ron mentioned, this not out of malice or spite and if the sponsor is really hard pressed for cash, I’m happy to wait. It’s just that I’d rather see he pay me off rather than spending it more on personal stuff.

How to complain our company for not being giving the salary on time? Since the pandemic came our salary was late 1 month. Can someone help me on how to complain our company?
